You guys are Quick to Judge Juan ….Yes it was a joke gone badly
wrong 100%…..the actual mark on his leg was the size of a pimple. Have none of you ever pulled a practical joke ??

However that same stipe/clerk of scales has an ongoing history of being drunk on duty, borrowing money from owners, trainers and jockeys, not paying back these loans etc. I am personally still owed R2000 from 5 years ago.

Why is a stipe getting lifts from a trainer ??

When will his inquiry be heard ??

Again we talking different rules for different folks. Going back AGAIN to the Moodley/ Wainstein confrontation. Wainstein charged (kicked out on appeal) but nothing done to Moodley about his shocking behaviour ? Because he apologised to Binda and Maroun? I got R30K for saying s&#t. But Moodley could stand up and tell all that he could “do whatever I like because I’m the CEO”. Juan apologised to Stipe immediately ??

Anything that causes an injury to someone, is no longer a prank, irrespective of the severity.

Furthermore, the prankster does not get to rate the severity of the injury either.

it seems to me that there is far more to this story that the press release has left out - were these 2 people friends( I'm sure they are not now) Was this a joke? It seems as though it is being judged as an attack on the NHRA therefore the harsh fine - I have an opinion but without all the facts its worthless

'Mr Nel has the Right of Appeal against the finding and the penalty imposed'

So surely he will appeal - and then hopefully ALL the facts get reported ?

Rule 72.1.44 at any time assault, abuse, exploit, swear at, or intimidate any PERSON or individual in his
employ at his training establishment.

The plot thickens in my opinion. This is the rule Juan allegedly contravened. Maybe it is just a typographical error, or can it be the stipe was in Juan's employment? Or maybe I am just missing the point?

But, point is, you cannot go around assaulting people. But what I was really trying to say in my previous post was to compare the punishment for the jock (Greg) to Juan's punishment.

And just to say something about Mark's comment, it certainly appears to the man in the street that the stipes are above the law...

there is not that much of a difference in the fines - i would think in 45 days Cheyne would lose close to 100k or more in riding fees and stakes but obviously he does not get a suspended sentence...

Mr Hawaii…..a bad joke.

Juan gave stipe a lift home after races and when stipe got out of the car and after both saying goodbye Juan shot him with his air pistol as a joke . On realising that it was a bit close Juan turned around and went back to apologise . Apology accepted …

Frodo…appeal costs are large
R9k to lodge
R25k for attorney.
Appeal can take up to 18 months while NHA hold your money.
And if you lose the appeal NHA take your deposit and can even increase the fine

My appeal actually cost me more than the fine but was a matter of principle.
Because my appeal was deemed worthy I got my money back and fine was halved.
NHA even broke their own rules as they has the same person hold my inquiry and appeal…..totally wrong.

Asking any attorneys wether in SA law can the same judge that sentenced you appear on your appeal?

My attorney was adamant that it can not be done
